What Being Local Means
One thing that we are very proud of here at LCTaylor is that every single one of our Bankruptcy and Consumer Proposal files are administered entirely from our office right here in downtown Winnipeg. In fact, it couldn’t be done any other way, because this is the only office in which we have staff.
Now, as someone reading this who is looking for help with their debt and is considering who they should speak with, you may be thinking “Isn’t that obvious? Where else would my file be handled? If I deal with a Winnipeg lawyer, everything is handled in their office. If I deal with a Winnipeg accountant, everything is handled in their office. Why would my Bankruptcy or Consumer Proposal be any different?”
You may be very surprised to find out that it can be quite different, depending on who you are dealing with. Many of the larger “national” firms that administer Consumer Proposals and Bankruptcies filed by Manitobans, have processing centers located in other provinces. Those centers handle most of your file after the Bankruptcy or the proposal has been started. Some other firms have no local staff, and must fly into the city “by appointment only” from places such as Calgary and Toronto if they need to meet with clients or attend court. Usually, they meet with clients online or the telephone, and in-person appointments are not available.
Why does working with a local Trustee matter?
The next, and probably most important – a question from your perspective may be “Okay, so these big companies are saving a few bucks by outsourcing my file to another province, but is it really going to make a difference for me and my Bankruptcy or Consumer Proposal?” That’s a good question.
It matters that Bankruptcies and Consumer Proposals are affected by BOTH federal and provincial legislation and courts, and that an out-of-province person is not likely to be familiar with the unique court rulings and exemptions in Manitoba.
It matters that the out-of-province person filing your tax return (a requirement of every Bankruptcy) is not based in Manitoba and may not be familiar with all of the Manitoba tax regulations and credits you may be entitled to.
It matters that the out-of-province person reviewing your paystub and determining how much you are required to pay into the Bankruptcy may not be familiar with certain unique-to-Manitoba deductions and dues that are coming off your pay cheque.
It matters that the people looking after the various aspects of your file aren’t all under the same roof for ease of reference and communication, making sure that nothing falls through the cracks.
You must decide whether dealing locally matters to you. What we can tell you is that we like meeting in person with our clients whenever possible and getting to know them and their needs and concerns.
